eligibility:
Open Only to Legal Residents of the fifty (50) United States and the District of Columbia, 13 years of age or older. Void Where Prohibited. Employees (and their immediate families (parent, child, spouse, or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of the New Museum of Contemporary Art (”Sponsor“), its parent, affiliates, subsidiaries, and advertising and promotion agencies are not eligible to enter or win. By participating, entrants (and, if eligible minors, their parents and/or legal guardians) agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this promotion. Promotion is subject to all applicable federal, state, and local laws.
PROMOTION PERIOD:
Promotion begins at 12:01 a.m. Eastern Time (“ET”) on March 14, 2011 and ends at 11:59 p.m. ET on May 8, 2011 (the “Promotion Period”), and will be divided into weekly Entry periods (each, a “Weekly Entry Period”), with each Weekly Entry Period beginning at 12:01 a.m. ET on Monday and ending at 11:59 p.m. ET on the following Sunday.

If you don’t already follow @newmuseum on Twitter, visit http://twitter.com/newmuseum and click on the icon to follow @newmuseum. Tweet a Review: After viewing the George Condo: Mental States exhibit at the New Museum of Contemporary Art, tweet a one-word review about the exhibition using #GeorgeCondo (each, a “Review Entry”). To clarify, Review Entries containing special characters or symbols (including, without limitation, “&” and “-”) are not eligible and will not be considered.  As of April 3, 2011, at 12:01 a.m. Eastern Time, only one-word Review Entries that are 16 letters or fewer will be eligible for submission; Review Entries containing more than 16 letters will not be considered. If the same Review Entry is tweeted by more than one person or from more than one email address/Twitter account, only the first person to tweet that Review Entry during the Promotion Period is eligible. Sponsor reserves the right to reject and remove or exclude any Review Entry containing profanity or that Sponsor otherwise deems inappropriate, in its sole discretion. Retweet a Review: Visit http://bit.ly/235ms and retweet a Review Entry from the list provided that inspires you the most to go visit the exhibition (each, a “Retweet Entry”). Limit one (1) Review Entry and one (1) Retweet Entry (referred to collectively and separately as “Entry” or “Entries”) per person/email address/Twitter account per Weekly Entry Period. Multiple Tweet Review Entries or Retweet Entries received from any person/e-mail address/Twitter Account during the same Weekly Entry Period will be void. All Entries must be received by 11:59 p.m. ET on the last day of the applicable Weekly Entry Period to be eligible. You must have a Twitter account to participate. If you do not have a Twitter account, establishing an account is free. Entries generated by script, macro, or other automated means or by any means which subvert the entry process are void. All Entries become the property of Sponsor and will not be acknowledged or returned.
WINNER DETERMINATION:

Review Prize Winner Determination: Following the conclusion of any Weekly Entry Period, the Review Entry submitted during that Weekly Entry Period that was retweeted the most, as determined by Sponsor in its sole discretion, will be deemed that Weekly Entry Period’s potential Review Prize winner. For any given Weekly Entry Period, only Review Entries submitted during that Weekly Entry Period will be eligible; Review Entries submitted before or after that Weekly Entry Period will not count for that Weekly Entry Period. Only unique retweets will count toward determining the most retweeted Review Entry. If the same Review Entry is retweeted by the same person/email address/Twitter account more than once, only the first retweet will count towards winner determination. Retweet Prize Determination Winner: One (1) potential winner for each Weekly Entry Period will be selected in a random drawing, held on or about the Monday following the Weekly Entry Period’s closing, from all eligible individuals who retweeted the winning Review Entry for that Weekly Entry Period (e.g., if you retweet the Review Entry that was retweeted the most during that Weekly Entry Period, you will be included in a drawing to determine that Weekly Entry Period’s potential Retweet Prize winner). Odds of winning depend on the number of eligible Entries received. Limit one (1) prize (whether a Review Prize or Retweet Prize) per household.

Sponsor will send each potential winner a message from @newmuseum to each potential winner’s Twitter account used to enter with instructions on how to claim the prize. In order to receive a message from Sponsor, you must (a) be following @newmuseum and (b) have your account settings set to “unprotected” and/or “public.” If a potential winner does not respond and comply with the instructions in the direct message within five (5) days after Sponsor sent the message, prize notification is returned as undeliverable, or a potential winner is not in compliance with these rules, the prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected for the prize at issue.

PRIZES:
Review Prize (one (1) per Weekly Entry Period): Individual Membership for one year to the Museum. Approximate Retail Value (“ARV”): $60.00 each. Retweet Prize (one (1) per Weekly Entry Period): One-time admission for two (2) to see the George Condo: Mental States exhibition at the New Museum of Contemporary Art. ARV: $24.00 each. Total ARV of all prizes: $672.00. Admission and membership are subject to terms and conditions specified by Sponsor. Winners and guests must comply with all New Museum of Contemporary Art rules and regulations. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Winners may not substitute, assign, or transfer a prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state, and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion.
GENERAL CONDITIONS:
Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, or garbled tweets, retweets, messages, Entries, or email; or for lost, interrupted, or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications, or failed computer, satellite, telephone, or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing, or otherwise relating to or in connection with the promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the promotion, the processing of Entries, the announcement of the prizes, or in any promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the promotion. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this promotion or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the promotion or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the promotion be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or proper play, or submission of Entries, Sponsor reserves the right, at its sole discretion, to suspend, modify, or terminate the promotion and, if terminated, at its discretion, select the potential winners for the prizes at issue from all eligible, non-suspect Entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Entrants (and, if eligible minors, their parents and/or legal guardians), by participating, agree that Sponsor, Twitter, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies and all of their respective officers, directors, employees, representatives, and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants (and, if eligible minors, their parents and/or legal guardians) against, any liability for any injuries, losses, or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of any prize or participation in this promotion. Each winner (and, if an eligible minor, his or her parents and/or legal guardians), by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade, and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. In the event of a dispute regarding Entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of Entry will be deemed to be the entrant and must comply with these rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
